I thought about an earlier episode. Is it not a grave consistency problem that desmond calls penny in this episode and says to her that they won't see each other for 8 years when we know that desmond met with penny at the stadium prior his entry in the boat competition?
Yeah, I can't think of any inconsistencies. The fact that the meeting at the stadium doesn't include questions like,"do you still have the same number?" or "are you still going to call me in x years?" comes close, but you could consider that one of those conversations "off camera". _________________ □
1996 Desmond does not know that Penny will seek him out, it has not happened to 1996 Desmond.
Also, the stadium meeting happened in the old time line - prior Desmond turning the key and unleashing the electromagnetic blast - prior to being involved in course corrections/unstuck in time. So the encounter in the stadium may not have really happened, or happened differently due to Desmond saving Charlie all those times.
I hear what you're saying, and I won't pretend to understand the ins and outs of time travel, but I like to think that the Constant sort of 'book ends' the Desmond and Penny story from season two, which would include Desmond's interaction with everyone on the island. In a way that would be like the writers saying, 'forget season two, that got blown out with the fail safe'.
Yes, they are separate, sort of self contained episodes, but I think that they compliment each other rather than exclude each other.
Yeah, I think artistically the story does boxend as you say.
But, due to the time shifting and course corrections the writers have the explanation to potentially change the scene if they need to recreate continuity. I doubt it will happen, and I think they are happy with the old story episodes and would not need to redo them.

Yes yes yes, you've hit the nail on the head exactly! The Lost brand of time travel is with the mind travelling, and in this episode its 1996 Desmond travelling forward. Thus he only knows that in 1996 he's split from Penny, and in 2004 he's on the boat. He doesn't know about the stadium because it hasn't happened yet. _________________ "So we saved the world together for a while, and that was lovely." --Desmond
Yes, Desmond from 1996 became unstuck and received instructions from 2004 Faraday to seek out 1996 Faraday.
Desmond subsequently finds Penny and then promises not to contact her in eight years. He kept his word because in (2000/2001?) she found him.
This is the part of Chris in Oly's comments that I found interesting:

Is the stadium scene discarded or overwritten by a new story/ time line?
Let's not forget that the Swan implosion sent Desmond back to the earliest point in his story we've yet to see, where he is contacted by Ms. Hawking, soon after he joins the Royal Army where he jumps forward to the Desmond on/near the freighter because he finally took her advice and went to the island.
The stadium scene seems out of place because Desmond doesn't tell Penny,'a strange old lady who travels through time told me I had to go to an island to push a button'. He opted for the more simple explanation 'I have to prove my honor'.
I think Desmond's story, past and present, follows the same time line, there are just a few course corrections along the way. _________________ □
Penny: What are you doing Desmond? You avoid me and now you are going on a boat trip?
Desmond: I have to Penny. I have to prove I am a man worthy of your father and his whiskey. Also, I am a little unstuck in time. I met this physicist in oxford, Farady. Nice guy. Taught me that you are my constant and as long as I love and have you I won't go insane and bleed out my nose.
Penny: What? You're becoming co-dependent? You won't marry me, but I am your constant?
Desmond: Oh, that. Well you see, there was this little old lady named Hawkins. She explained that I can see flashes of the future. And that no matter what I did, I would end up crashing on an island to push a button to save the world.
Penny: What have you been putting in your fruit loops? Have you gone crazy? Faraday and Hawkins are real scientists who wrote books and research. Are you sure you have not fallen off the ladder again? A bump to head would explain all of this.
Desmond: No way brotha'. If there is one thing I know it is as soon as I get with a 1000 miles of Australia I will crash land on a mysterious island. Then I will live in an underground hatch with another man, a crazy former CIA agent; pushing a button every 108 minutes; drinking together; bonding about the hostiles and viruses; never seeing another person for almost a year; just each other.
Penny: Are you telling me you are bi? You don't need to pretend to be crazy. It does explain the monastary and the army though.
Desmond: No, no, Penny. I am not bi, just destined. You don't understand.
Penny: Well, that is certainly true. Maybe we do need to see other people, you taking a trip might be for the best.
Desmond: No, no, Penny. I love you and think you are great. Once I save the world it is just you and me, brotha'.
Penny: Umm...sure. Call me in 2004, and we'll see where we stand.
