I think it was a little too hasty to accept a donation from a person who left ONLY a name. which also brings up links to oh-so-hateable ppl like these in google:
http://www.seanstewart.org/
http://tbn0.google.com/images?q=tbn:MU5xKgKUNOB3EM:http://blog.l2bwomen.com/wp-content/sean-stewart- 2.JPG
and turns up over 300 names in the online white pages search making the name pretty untrackable
There is always a chance of a chargeback if a credit card was used, deliberately or not. If that happens, you (fslslayer probably since he used his name in the transaction) are liable to pay the balance.
Think chargebacks are impossible cuz paypal is so secure? Read:
http://maplestory.nexon.net/WZ.ASPX?PART=/News/Notice&bbsidx=3255
There is possibly even a $2.5k fine from Paypal for breaking the user agreement
" In connection with your use of our website, your Account, or the Services, or in the course of your interactions with PayPal, a User or a third party, you will not:... Infringe PayPal’s or any third party’s copyright, patent, trademark, trade secret or other intellectual property rights, or rights of publicity or privacy;"
***but it doesnt seem likely because there was no payment for services, just a donation***
But then again theres always this:
"10.1 Your Liability. You are responsible for all Reversals, Chargebacks, Claims, fees, fines, penalties and other liability incurred by PayPal, a PayPal User, or a third party caused by or arising out of your breach of this Agreement, and/or your use of the Services. You agree to reimburse PayPal, a User, or a third party for any and all such liability."
oh and a chargeback probably would break "9.1.o. Allow your Account to have a negative Balance;"
back in the vidiac site it was ok because the vidiac ppl were liable which is probly why they took down certain things without your permission or notification as stated in their user agreement:
"Vidiac respects the rights of copyright holders. As a user of this system you agree to use this service in accordance with the laws of the United States. This includes but is not limited to use of copyrighted or trademark material. If someone claims you are infringing on their copyrights or trademarks, Vidiac may and without warning to you remove your content."
Btw, that kinda makes your DMCA notice void since the copyright owners can just contact the vidiac.com ppl instead of you.
Even though there is a lot of risk, I have yet to think up a motive besides someone really really hates you.
but on the other hand i have yet to think up a reason why someone would be willing to donate that large amount of money so anonymously (remember that none of the admins has any clue who he/they could be)
downloading copyrighted material is easy enough to get away with. distributing is a whole different story.
last words: a forum or something like that for anime is good enough. most fansites just link to a big name in hosting or make the torrent available. the only real thing i see to gain from actually hosting anime is e-fame. if theres anything ive learned over the past 4 or 5 years of mmo gaming, its this: e-fame is worthless

p.s. i have no education in legal issues and whatnot. Im just posting this cuz I like bursting ppl's bubbles. (but really its to save your financial futures...i guess?)
p.p.s. seeding torrents is good enough imo if you wanna spread anime and whatnot |
